Terms of Use - Submitting to Archive

The YEG Police Violence Archive (referred to hereafter as the "Archive") aims to provide a publicly accessible database of incidents of police violence and police-perpetrated sexual violence in Edmonton, and to give victim-survivors of police violence a space to have their experiences recognized.

In granting permission for the Archive to publish your submission, you warrant that you are 18 years of age or older and have the full power and authority to consent to this agreement, that your submission does not infringe any existing copyright or contain any false or libelous matter, nor invade any third-party rights of privacy or publicity. If your submission does contain libelous or slanderous matter, you understand that you may be subject to legal action. You further agree to defend and hold harmless the Archive, its hosted website, its volunteer members, and ancillary groups and their employees against all claims, demands, costs, and expenses including attorney's fees incurred for any and all claims of copyright infringement or any other legal or regulatory course of action arising from the use of your material.

The Archive has no obligation to use or publish your contribution. You retain ownership of and copyright in the material you share.

By submitting your contribution, you grant a worldwide, non-exclusive, royalty-free license to the Archive to preserve and make your work accessible via the Archive's website. This permission includes the right to modify your material to conform to the goals of the Archive, to reformat it as necessary to preserve its perceptibility and usefulness, and to make it available for educational, research, promotional purposes outside of the project, in all media formats. This license does not authorize exploitation of your contribution for profit or commercial use. Your permission may be revoked at any time by submitting a (digital) written request to the Archive to remove your contribution, however, the Archive cannot be held liable for any third-party organizations or individuals who may have independently preserved your materials.

Ok I didn’t get any of that - say again in plain English?

  • Contributors need to be at least 18 years old and able to agree for themselves
  • Your submission must belong to you (not, for example, downloaded from someone else’s social media). If you appear in a video or pictures someone else took, we encourage you to get their permission before sharing it to the Archive, but as long as it is publicly posted (such as on social media) you are welcome to share it
  • Your submission must be truthful to the best of your knowledge; it is important to know that if you make false claims in your submission, you could risk legal action
  • The YEG Police Violence Archive, Archive team, and SAVE are not responsible for legal action that could happen as a result of the Archive publishing your submission
  • We can’t promise that we will publish your submission. Read our submission screening process for a list of some reasons we might not publish, or would make changes to your submission before publishing it. Your material still belongs to you even if we publish it.
  • Choosing to submit to the Archive gives us permission to share your materials on the site for free, and to make changes within our submission screening process (most often, blurring out faces of victims or bystanders). You are not giving us permission to sell your submission or make money from it
  • You can always withdraw your submission by request to our team, but we can’t guarantee that someone else won’t have saved it outside the Archive.

Approval Criteria

  • Content is related to police violence in Edmonton and area.
  • Users have the right to submit content and submission does not infringe any existing copyright.
  • Content does not provide personal information of the contributor or any other individual, including addresses, phone numbers, etc.
  • Content does not endorse any commercial product.
  • Content does not pose a risk of damage to the network, computers, or servers of the Archive.

Revision

Incidents submitted to the archive are not investigated by archive volunteers to verify their accuracy; all incidents published on the archive are alleged unless proven otherwise. We will revise content of submissions prior to publication in two situations:

  1. Anonymization: Unless those submitting their stories have specifically waived their right to confidentiality (eg. are already speaking publicly about their experience in other venues and have connected to those stories here), archive volunteers will remove obvious identifying information, particularly names, of survivors of police violence sharing their story with the archive. This is done to allow survivors to share their experiences without creating digital paper trails to the rest of their lives (such as showing up when an employer searches their name) and to minimize the risks of litigation for testimonials. All stories submitted pertaining to individuals aged 18 or under at the time of submission will be anonymized.
  2. Removal of slurs/harmful language: The archive does not condone the use of slurs and harmful language (eg. racist, homophobia, anti-semitic, transphobic, ableist, sexist, or other discriminatory language) and will remove these from submitted incidents prior to publication. Any such language will be replaced with asterisks **** if brief, or whole sentences/portions of the submission may be removed if the language is broadly used throughout. This is to ensure that the online space of the archive is not reproducing discriminatory beliefs; however we hope to still be able to share as many people's stories as possible. Submitters are encouraged to avoid the use of such language in their submissions.

Copyright

Your submission to the Archive is covered by a Creative Commons Attribution NonCommercial 4.0 International Public License. By using one of our public licenses, a licensor grants the public permission to use the licensed material under specified terms and conditions. If the licensor’s permission is not necessary for any reason–for example, because of any applicable exception or limitation to copyright–then that use is not regulated by the license. Our licenses grant only permissions under copyright and certain other rights that a licensor has authority to grant. Use of the licensed material may still be restricted for other reasons, including because others have copyright or other rights in the material. A licensor may make special requests, such as asking that all changes be marked or described. Although not required by our licenses, you are encouraged to respect those requests where reasonable.

Third-Party Use

The Archive is not positioned to grant licenses to or approve requests from third parties to make use of content in the collection. Summary content generated by the YEG Police Violence Archive, such as statistical reports, are for public use and do not require permission to reprint, but cannot be changed or used for commercial purposes.

Legal Disclaimer 

Unless stated otherwise, all incidents published on the Archive are allegations. The Archive team does not independently verify each incident.

We recognize that the requirement to prove that violence took place often has a silencing effect on victim-survivors. People submitting their stories do not need to prove the incident took place - we believe you.
 

General Site Terms and Conditions

1.      Introduction

(a)   These terms of use explain how you may use this website (“Site”). References in these terms to the Site includes the following websites: YEG Police Violence Archive (“YEGPVA”) and all associated web pages. You should read these terms and conditions carefully before using the Site. By accessing or using this Site or otherwise indicating your consent, you agree to be bound by these terms and conditions and the documents referred to in them. (b)   Definitions

Content” means any text, images, video, audio or other multimedia content, software or other information or material submitted to, subsisting on or accessible from the Site;

We”, “Us” or “Our” means Sexual Assault Voices of Edmonton and our initiative the YEG Police Violence Archive (YEGPVA) a digital archive of incidents of police violence containing descriptions, images, videos, and documents relating to incidents of violence allegedly committed by police officers, correctional officers, and other actors. 

You” or “Your” means the person accessing or using the Site or its Content.

(c)   Privacy Statement: these terms include our Privacy Statement which shall be subject to these terms in the event of any conflict or inconsistency.

(d)   This Site is intended for and directed to residents of Canada over the age of 16 years.

 2. Restrictions On Use 

(a)   The Site is for Your personal and non-commercial use only. As a condition of Your use of the Site, You agree: 

(i)              not to use the Site for any purpose that is unlawful under applicable law, or prohibited by these terms and conditions;

(ii)            not to defame or disparage anybody or make comments of an obscene, derogatory or offensive manner or otherwise use the Site or its Content in a way that unreasonably brings Us or any third party into disrepute or causes Us to be liable to any third party; 

(iii)          not to reverse engineer, decompile, copy, modify, distribute, transmit, license, sublicense, display, revise, perform, transfer, sell or otherwise make available to any third party or otherwise publish, deep-link, create derivative works from or exploit in any way the Site or its Content except as permitted by Us under these terms and conditions or as expressly provided under applicable law or under any Additional Terms;

(iv)           not to use the Site to distribute viruses, malware or other similar harmful software code;

(v)             not to represent or suggest that We endorse any other business, product or service unless We have separately agreed to do so in writing; and

(vi)           that You are solely responsible for all costs and expenses You may incur in relation to Your use of the Site.

(a)   This Site and all intellectual property rights in the Site (including without limitation any Content) are owned by us or our licensors. We and Our licensors reserve all Our intellectual property rights (which include without limitation all copyright, trademarks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind) whether registered or unregistered anywhere in the world.

(b)   Nothing in these terms and conditions grants You any rights in the Site other than as necessary to enable You to access the Site. You agree not to adjust to try to circumvent or delete any intellectual property notices contained on the Site and in particular in any digital rights or other security technology embedded or contained within any Site Content.

(c)   Trademarks: The use or misuse of any trademarks or any other Content on the Site except as provided in these terms and conditions is strictly prohibited. Nothing contained on the Site shall be construed as granting, by implication, estoppel or otherwise, any licence or right to use any trademark without Our prior written permission.

 4.     Submitting Information to the Site

(a)   The Site is not a secure means of communication and any confidential inquiries should be directed to Us via email at yegpva@protonmail.com. Alleged incidents of police violence submitted to the Site will be lightly edited in accordance with these terms and conditions by Our editorial team before publication to the public-facing Site. With the exception of contact information for the submitter of an alleged incident, no information will be retained on the backend of the Site that is not published. For that reason, You should not submit or send to Us any advertising or marketing suggestions, prototypes or any information, written or oral, which You regard as confidential or commercially-sensitive or valuable (collectively referred to as “Unwanted Submissions”). While We value Your feedback, You agree not to submit any Unwanted Submissions. Any submission (including any Unwanted Submission) made to Us is understood to be intended for publication to the Site. By transmitting or posting any submission or other material to Us, You agree that, subject to Our Privacy Statement, We are entitled to use any such information in a manner that conforms to any confidentiality restrictions You have placed on it (for example, a request to blur the faces of people involved in an incident) for use on the Site. In accordance with the restrictions on third-party use specified in a submission, we may reproduce, transmit, publish, broadcast or post on any media anywhere in the world on a free-of-charge basis. You acknowledge that intended restrictions on third-party use are not enforceable and agree not to hold the Site liable for unauthorised third-party use of Your submitted materials. We shall not be subject to any obligation of confidentiality nor be liable for any use or disclosure of such submissions. 

(c)   You represent and warrant that any Content You supply to Us is and shall be Your own original work and has been lawfully provided to Us and that you have all necessary consents to provide this to Us and that, if You consent to it, We shall be entitled to disclose Your name with any such Content that We may choose to publish. You agree that you waive all moral rights You may have in any such Content but that any personal data you supply with Your Content may, if we choose to do so, be used by Us as described in our Privacy Statement.

5.      Accuracy of Information and Availability of the Site

(a)   We do not represent, warrant or promise (whether expressly or by implication) that any Content on the site is or remains available, accurate, complete and up to date, free from bugs, errors or omissions or fit or suitable for any purpose. Any reliance You may place on the information on this Site is at Your own risk and We may suspend or terminate operation of the Site at any time at our sole discretion. (b)  Prior to publication, the editorial team reviews submissions and may provide light editing; however, we do not provide fact-checking for the incidents published on the Site. Unless supported by a legal ruling, all incidents of violence published on the Site are understood to be allegations unproven in a court of law.

(c) While we make commercially-reasonable efforts to ensure that the Site is available, we do not represent, warrant or guarantee in any way the Site's continued availability at all times or uninterrupted use by You of the Site.

6.     Hyperlinks and Third Party Sites

(a)   The Site may contain hyperlinks or references to third-party websites other than the Site. Any such hyperlinks or references are provided for Your convenience only. We have no control over third-party websites and accept no responsibility for any content, material or information contained in them. The display of any hyperlink and reference to any third-party website does not constitute an endorsement of such third-party's website, products or services. Your use of a third-party website may be governed by the terms and conditions of that third-party website.

7. Warranties and Limitation of Liability

(a)   You agree that Your use of the Site is on an “as available” basis. As stated above, except as otherwise expressly required by applicable law, we make no representations, warranties, conditions or other terms (whether express or implied) in relation to the provision of the Site, including without limitation as to completeness, accuracy and currency or any Content on the Site, or as to satisfactory quality or fitness for a particular purpose.

We reserve the right to vary these terms and conditions from time to time. Our new terms will be displayed on the Site and by continuing to use and access the Site following such changes, You agree to be bound by any variation made by Us.
